Role of TEER Category in Canadian Immigration 

TEER categories are important because: 

• They offer an organized and uniform method for categorizing various jobs within the Canadian job market which in turn helps immigration officials in assessing the job duties and responsibilities carried out by you if you are planning to immigrate to Canada 

• Your TEER category plays a crucial element in your eligibility for the Federal Skilled Worker Program, Federal Skilled Trades Program, and Canadian Experience Class. Points are granted based on your level of education, work history, language skills, and a job offer. The TEER category of the position being offered is a significant factor in the assessment 

• TEER plays an important role in the LMIA process as well (this is where Canadian employers hire foreign workers to fulfil the labour market shortage). If a Canadian employer hires you through the LMIA process, your job offer must have a corresponding TEER code and your employer must prove that they have made all the possible efforts to hire Permanent residents or Canadian citizens before hiring you (foreign worker)  

• Canadian provinces have their immigration programs as well known as the Provincial Nominee Program (PNP). If you wish to apply for a PNP, your TEER category determines your eligibility

IRCC adjusts the proof of funds amounts on an annual basis, using 50% of the low-income cut-off totals as the benchmark. To maintain eligibility, individuals need to update their settlement fund figures in their Express Entry profiles. These funds serve as evidence that applicants possess sufficient financial resources to settle in Canada. It is mandatory for anyone receiving an invitation to apply (ITA) through an Express Entry draw to provide written proof of these funds. 

It’s important to note that applicants under the Canadian Experience Class category are exempted from demonstrating the ability to support themselves and their families financially. Moreover, individuals who hold valid job offers and are authorized to work in Canada are also exempt, irrespective of whether they apply through the Federal Skilled Worker Program or the Federal Skilled Trades Program. 

Who is required to show proof of funds?  

This requirement applies to those seeking to meet the minimum criteria of the Federal Skilled Worker Program and the Federal Skilled Trades Program. 

The specific amount of funds needed varies depending on the size of the candidate’s family, which includes themselves, their spouse or common-law partner, and dependent children from either party. It’s worth mentioning that even if these family members are Canadian citizens or permanent residents who are not relocating to Canada, their financial inclusion is mandatory. 

To demonstrate proof of funds, individuals must obtain official letters from their respective banks or financial institutions where they hold accounts. These letters must be printed on the institution’s letterhead and include relevant information such as contact details, outstanding debts, and comprehensive details of all current banking and investment accounts held by the applicant, including account numbers, opening dates, current balances, and average balances over the past six months. 

IRCC emphasizes that the funds must be accessible both during the application process and upon receiving the permanent resident visa. Applicants must provide evidence that the funds can be legally accessed upon arrival in Canada. Notably, using real property equity as proof of settlement funds or borrowing money from another person is not acceptable. 

Furthermore, applicants must demonstrate their ability to utilize these funds to cover their family’s living expenses, even if the family members are not accompanying them to Canada. If the applicant is immigrating with a spouse or partner, funds held jointly can be counted. In some cases, the spouse’s separate account may also be considered, provided it can be proven that the funds are accessible as needed. 

Considering the varying cost of living across Canada, IRCC advises applicants to bring as much money as possible, facilitating their transition and the process of finding a home within the country. It is essential to declare any amount exceeding CDN$10,000 to the border officer upon arrival in Canada.  

Failure to do so may result in penalties and confiscation of the undeclared amount, including cash and documents representing payable property or capital, such as stocks, bonds, debentures, and treasury bills. It also covers documents guaranteeing payment, such as banker’s drafts, checks, money orders, and travellers’ cheques.

Currently the amendment is being addressed in the Canadian Parliament… but what might it mean for you? Continue reading for more information on the proposed changes to Canada’s Express Entry system.

What is Express Entry?

Express Entry refers to an application management system for three Canadian immigration programs: the Federal Skilled Worker Program (FSWP), the Canadian Experience Class (CEC), and the Federal Skilled Trades Program (FSTP). In order to immigrate to Canada through one of these programs, foreign workers must express their interest by completing a profile in the Express Entry system.

Due to the pandemic, FSWP and CEC draws have been temporarily paused, and only candidates from Provincial Nominee Programs (PNPs) have received invitations to apply. However, the programs are on track to reopen for candidates in the summer of 2022.

After completing their applications, eligible candidates will receive a score based on their work experience, educational background, language skills, age, and a variety of other factors. Currently, candidates who receive the highest scores are invited by the IRCC to apply for permanent residence. With the proposed amendment, the way that candidates are selected to apply for permanent residence would change; they would be assessed according to criteria additional to their application score.

What are the Proposed Changes?

The changes are meant to improve Canada’s ability to select applicants that match its current economic needs. Under the amendment, Canada would be able to conduct targeted draws aimed at selecting individuals who possess skills that address areas like Canada’s labour shortages, or that would help Canada reach other economic goals as defined by the immigration minister.

Those who fit these criteria would be added to a preferred category within the immigration pool, and invitations would be sent out to top-ranking candidates within that category. Factors such as work experience, educational background, or language skills could become eligibility requirements to become a member of a specific category, and therefore prioritized for immigration. For example, if there was a desire to support Canada’s tech industry, category criteria could be based on work experience in the sector or a specific educational credential. This categorization could be applied to any industry in which Canada is experiencing a shortage or need, such as the healthcare industry.

Express Entry Criteria & Transparency

You might be wondering how you will know if you fit into an Express Entry category under these proposed changes. Draw details, including unique eligibility criteria, would still be published on the IRCC Website. The specific economic goal that the category is seeking to fulfill would also be disclosed, and the immigration minister would report annually to Parliament on the use of the draws.

However, critics believe that further oversight will be needed, including a transparent, formal, and established criteria for determining the categories. This oversight would ensure fairness in selecting the categories, what criteria would be prioritized, as well as prevent the draws from becoming overtaken by lobbyists. Currently, the proposed changes are being researched, and requested changes to the amendment will be considered on May 27.
